The next skirmish in the battle over the waterfront would come from a competitor, Western Pacific Railroad.
Southern Pacific still claimed the waterfront as defined in the original act of incorporation. (see appendix page #) Unfortunately for them the jetty building and dredging of the bay had expanded the land mass of Oakland.
Western Pacific Railroad, determined to break this monopoly, intentionally and boldly ran their tracks onto this newly formed land. The lawsuits of 1907 which Southern Pacific brought on, which Western Pacific expected, brought into question the ownership and definition of the Oakland waterfront in the court system once again, this time a more even confrontation - corporation vs corporation instead of person vs corporation.
